Terms & Conditions

By booking a service or purchasing a package from Houston Front Door Pumpkins ("Houston Front Door Pumpkins," "we," "our," or "us"), you ("Client" or "you") agree to the following Terms & Conditions.

1. Introduction

Welcome to Houston Front Door Pumpkins. These Terms & Conditions govern the purchase, delivery, installation, and removal of our seasonal porch decorating services. By submitting a booking or making payment, you acknowledge that you have read, understood, and agree to these Terms.

2. Services Provided

Houston Front Door Pumpkins provides seasonal porch decorating services, including the delivery, installation, and optional removal of pumpkins and decorative accessories.

All services are subject to seasonal availability. We reserve the right to modify, substitute, postpone, or discontinue services when necessary due to inventory, weather, or other circumstances beyond our control.

3. Purpose & Use of Products

All pumpkins, hay bales, corn stalks, florals, and decorative items provided by Pumpkin Porch Company LLC are intended solely for decorative purposes.

Pumpkins are not intended for human or animal consumption.

Houston Front Door Pumpkins is not responsible for any illness, injury, property damage, or other loss resulting from the use of pumpkins or décor for any purpose other than decoration.

4. Financial Transactions

Full payment is required before delivery or installation.

Payment is accepted through our online invoicing system unless otherwise agreed upon.

All sales are final once delivery or installation has been completed.

Refunds will only be considered if:

• Houston Front Door Pumpkins is unable to complete the scheduled delivery; or

• A product arrives damaged due to our handling and is reported within 24 hours of delivery with photos.

5. Scheduling & Delivery

Clients do not need to be present during installation unless otherwise requested.

Once installation is complete, we will send photo confirmation.

Delivery dates and installation times are estimates and may change due to weather, traffic, seasonal demand, supply availability, or other unforeseen circumstances.

The Client is responsible for ensuring that the installation area is safe, accessible, and free of pets, vehicles, or obstacles.

6. Care & Responsibility

Responsibility for all pumpkins and décor transfers to the Client immediately upon completion of delivery or installation.

Houston Front Door Pumpkins is not responsible for:

• Natural aging or deterioration

• Rotting or fading

• Pest activity

• Theft or vandalism

• Wind or weather damage

• Damage caused by pets, wildlife, or third parties

Clients purchasing the Pumpkin Removal Add-On authorize us to return on the scheduled removal date to dispose of pumpkins and décor. Until removal occurs, the Client remains responsible for monitoring and maintaining the display.

Clients who do not purchase removal services are responsible for proper disposal.

7. Design Disclaimer

Every porch is unique.

Photos displayed on our website, advertisements, brochures, or social media are intended as inspiration only and may not represent the exact final design.

Pumpkin varieties naturally differ in size, shape, color, and texture. We reserve the right to substitute pumpkins or decorative materials based on seasonal availability while maintaining the overall style, value, and aesthetic of your selected package.

8. Health & Safety

Natural materials such as pumpkins, hay, straw, corn stalks, flowers, and other seasonal décor may contain dust, mold spores, insects, or allergens.

By booking our services, the Client acknowledges these inherent risks and assumes responsibility for any allergies or sensitivities affecting household members, guests, or pets.

9. Customer Conduct

We are committed to providing friendly, professional service and expect the same courtesy from our clients.

Harassment, abusive language, threats, discrimination, fraudulent activity, or unsafe conditions may result in cancellation of services without refund.

10. Intellectual Property

All Houston Front Door Pumpkins, photographs, marketing materials, package names, logos, and original porch designs are the exclusive property of Houston Front Door Pumpkins.

No portion of our designs or marketing materials may be copied, reproduced, sold, or used commercially without prior written permission.

11. Photography & Marketing

With the Client's permission, Houston Front Door Pumpkins may photograph or record completed porch displays for advertising, marketing, and social media purposes.

We will make reasonable efforts to conceal identifying information such as house numbers, addresses, license plates, and other personal details.

Clients may opt out of photography and video recording by notifying us before installation.

12. Limitation of Liability & Indemnification

To the fullest extent permitted by Texas law, the Client agrees to release, indemnify, defend, and hold harmless Houston Front Door Pumpkins, its owners, employees, contractors, and representatives from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or relating to:

• The placement, movement, handling, or use of pumpkins and décor after installation;

• Property damage, personal injury, illness, allergic reactions, or other losses associated with pumpkins or seasonal décor;

• Natural deterioration, weather, theft, vandalism, pests, or wildlife;

• Failure to properly maintain or dispose of the display.

Nothing in these Terms is intended to limit liability where such limitation is prohibited by applicable law.

13. Force Majeure

Houston Front Door Pumpkins shall not be liable for delays, cancellations, or inability to perform services due to events beyond our reasonable control, including severe weather, natural disasters, transportation delays, supplier shortages, governmental actions, labor disruptions, or other unforeseen circumstances.

14. Amendments

Houston Front Door Pumpkins reserves the right to update these Terms & Conditions at any time.

The Terms in effect at the time of booking shall govern that particular order unless otherwise agreed in writing.

15. Governing Law & Venue

These Terms & Conditions shall be governed by the laws of the State of Texas.

Any dispute arising out of these Terms or our services shall be resolved exclusively in the state or federal courts located in Fort Bend County, Texas.
